One project that I have been working on is providing mediation to those who are experiencing disputes. Although I am an attorney, I have found that bypassing attorneys when it comes to dispute resolution and taking the matter through mediation is a reasonable move for several reasons. One, mediation allows the parties to remain in control of the results and the solution they reach. Second, mediation allows for the dispute resolution to take place faster and at a fraction of the cost of litigation. Third, mediation allows for a workable and long lasting solution to the disputes.
In litigation, the results are highly unpredictable, the parties are at the mercy of the Judges and/or arbitrators and in litigation there is always a winner and a loser where the loser will always, as human nature dictates, look for revenge one way or another.
I often encourage my clients to consider mediation as a means of alternative dispute resolution instead of taking the matter through litigation.
